Most income tax notices are routine: a 143(1) intimation, a defective-return note or a refund adjustment, each with a fixed reply window. Here is what every common notice means, which section it cites under the 1961 and 2025 Acts, and how to respond online before the deadline.

    Frequently Asked Questions

Is an intimation under section 143(1) an income tax notice?

Technically yes, but it is not a scrutiny notice. It is an automated summary of how CPC processed your return. If the "as computed" column matches what you filed and shows nil demand or a refund, no action is needed. If it shows a demand, check the reason, then pay, rectify or dispute it on the portal within 30 days.

How many days do I get to reply to an income tax notice?

It depends on the type. A defective return must be fixed within 15 days. A proposed prima facie adjustment and a notice of demand allow 30 days. Under the 2025 Act a reassessment notice must give at least 30 days. Scrutiny questionnaires and show-cause notices state their own date. Always go by the due date printed on the notice.

Why do my notices still say section 143(1) and not section 270?

Because the 1961 Act continues to govern all tax years beginning before 1 April 2026. Returns for FY 2025-26 and earlier are processed and assessed under the old sections, even though the 2025 Act is in force. Notices citing new sections such as 270(1) or 263(7) will appear for tax year 2026-27 returns, filed from mid-2027.

Can the department reopen my return after five years?

Only in larger cases. For notices issued from 1 September 2024, reassessment is allowed up to 3 years and 3 months after the end of the assessment year. It can go up to 5 years and 3 months only if the escaped income is likely to be ₹50 lakh or more. A show-cause notice under section 148A must come first.

How do I check if an income tax notice is genuine?

Use "Authenticate Notice/Order issued by ITD" on the e-filing home page. Enter the Document Identification Number with your mobile number, or your PAN, assessment year, document type and issue date, and confirm with an OTP. A genuine notice will also be visible under Pending Actions in your e-filing account.

What if I miss the deadline for a defective return notice?

The return is treated as invalid, as though it was never filed. If the defect is cured after the deadline but before assessment, the officer may condone the delay. Otherwise you may have to file a belated or updated return, which can mean losing loss carry-forward and paying extra tax and fees.

Can I ask for more time to reply to a scrutiny notice?

Yes. In e-Proceedings, click Seek/View Adjournment, choose the date you need, give a reason and submit before the due date. Adjournments are at the officer's discretion, so ask early and use the time to assemble a complete reply rather than sending partial answers.

Received an income tax notice and unsure how to reply?

A well-documented first response often closes the matter, while a hurried one can widen it. Talk to Money n Wealth for help with your notice and a free portfolio review.
